The following policy describes the ways in which your data will be processed by resistArt gallery according to the General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as the “GDPR”).

Information about the data controllers of your data

In accordance with data security laws, the responsible authority: Gallery resistArt, can be contacted at email: contact@resistartgallery.com or personally at Patrycja Satora, ul. Pilotów 85/1, 31-462 Kraków.

The protection of your data is a key priority for us and we would like you to feel safe while visiting our website. We assure you that your data will be handled in accordance with the applicable data protection regulations [in Poland and the EU] and that the necessary technical and organizational measures in compliance with data protection are in place.

Your data

Your personal data will only be processed by us to the extent necessary and for the purpose of providing a functional and user-friendly website, including its contents, and the services offered here.

The following privacy policy is intended to inform you in particular about the type, scope, purpose, duration, and legal basis for the processing of such data either under our own control or in conjunction with others.

Your rights

With regard to the data processing to be described in more detail below, users and data subjects have the right:

  • to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data;
  • to correct or complete incorrect or incomplete data;
  • to the immediate deletion of data concerning them, or alternatively, if further processing is necessary to restrict said processing;
  • to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers;
  • to file complaints to the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions [in Poland the supervisory authority is the President of the Office for Personal Data Protection].

 

In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same. However, this obligation does not apply if such notification is impossible or involves an inconsistent effort. Nevertheless, users have a right to information about these recipients.

Information about the data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage will no longer apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.

Server data

For technical reasons, the following data sent by your internet browser to us or to our server provider will be collected, especially to ensure a secure and stable website: These server log files record the type and version of your browser, operating system, the website from which you came (referrer URL), the webpages on our site visited, the date and time of your visit, as well as the IP address from which you visited our site. The data thus collected will be temporarily stored, but not in association with any other of your data.

The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website.

The data will be deleted within no more than seven days, unless continued storage is required for evidentiary purposes. In which case, all or part of the data will be excluded from deletion until the investigation of the relevant incident is finally resolved.

Cookies

A cookie is a small piece of information sent by a web server to be stored on a web browser so that it can be read back later from that browser. The cookie is a text file saved in the browser’s directory and stored in RAM while the browser is running. The cookie may also be stored on the computer’s hard drive once a user logs off from that website or web server.

resistArt gallery and authorized third-party service providers collect information about users’ activities and experiences while visiting our website. Examples of tools that collect such information include but are not exclusive to: Google Analytics, browser cookies, web beacons, flash cookies, tracking pixels, and similar technologies.

We use data gathered about website activity (e.g., demographic data, browser type, IP address, pages visited, the day and time of visit) to target users for certain types of content, or to match up with email subscriber lists and/or to provide a better user experience.

Cookies can be managed through browser settings. To learn more, refer to the support instructions for each browser (Firefox, Chrome, Safari, or Internet Explorer). Be aware that disabling or deleting cookies can impact your ability to use certain features of that website. If disabling or deleting cookies, repeat this process for each browser and computer used. Note that cookies used by Adobe Flash cannot be controlled by browser settings.

We will treat any personally identifiable information that is collected on this website in a secure manner. If you prevent or restrict the installation of cookies, not all of the functions on our site may be fully usable.

Order processing

The data you submit when ordering goods and/or services from us will have to be processed in order to fulfil your order. Please note that orders cannot be processed without providing this data.

After your order has been completed, your personal data will be deleted, but only after the retention periods required by tax and commercial law.

In order to process your order, we will share your data with the shipping company responsible for delivery to the extent required to deliver your order and/or with the payment service provider to the extent required to process your payment.

Customer account/registration

If you create a customer account with us via our website, we will use the data you entered during registration (e.g. your name, your address, or your email address) exclusively for services leading up to your potential placement of an order or entering some other contractual relationship with us, to fulfill such orders or contracts, and to provide customer service . We also store your IP address and the date and time of your registration. This data will not be transferred to third parties.

During the registration process, your consent will be obtained for this processing of your data, with reference made to this privacy policy. The data collected by us will be used exclusively to provide your customer account.

You may revoke your prior consent to the processing of your personal data at any time with future effect. All you have to do is inform us that you are withdrawing your consent.

The data previously collected will then be deleted as soon as processing is no longer necessary. However, we must observe any retention periods required under tax and commercial law.

Newsletter

Our newsletter helps us keep you informed about events related to our activity as the gallery.

If you register for our free newsletter, the first step will entail providing personal data to initiate your registration, i.e. your e-mail address and – optionally – your name and address. This data will be transferred to us. We will also save the IP address of the internet connection from which you accessed our website, as well as the date and time of your registration. In the next step of the registration process, we will send you an email describing the newsletter’s content as well as providing you with our data protection declaration. This email will also serve as a means of obtaining your consent to send you the newsletter. We use the data obtained during the registration process only for the purpose of sending the newsletter – data is not passed on to third parties. If you choose to voluntarily provide your first and last names, we will use these, with your consent, as a means of addressing you in the newsletter.

You can withdraw your consent to the storage of your data and e-mail address any time, as well as its use for newsletter submissions. Please send a short e-mail to contact@resistartgallery.com. Each newsletter also contains an unsubscribe link.

Contact

If you contact us via email or the contact form, the data you provide will be used for the purpose of processing your request. We must have this data in order to process and answer your inquiry.

Your data will be deleted once we have fully answered your inquiry and there is no further legal obligation to store your data, such as if an order or contract resulted therefrom.
